GEORGIA NPDES STORMWATER

How to File a Georgia NOI

A Notice of Intent (NOI) is how a Georgia construction project asks for coverage under the state's NPDES stormwater permit. Here is who needs one, when to file, and how the process works.

What is a Georgia NOI?

A Notice of Intent (NOI) is the filing a construction project submits to request coverage under Georgia's NPDES stormwater general permit for construction activity. It is filed with Georgia EPD, the state agency that runs the program.

Who needs one?

Generally, a project that will disturb one acre or more of land needs permit coverage. EPD's own permitting flowchart asks whether the land disturbance will be equal to or greater than one acre, and if not, no EPD construction stormwater permit is needed. Some projects may be exempt, and local rules can apply on top of the state's, so check with EPD or your local authority if you are unsure.

Which NOI you file also depends on your role in the project. See our page on primary, secondary and tertiary permittee NOIs.

When do you have to file?

A new NOI is due at least 14 days before the construction activity begins. Plan the filing early, so permit coverage is in place before any land disturbance starts.

How the process works

  1. 1
Work out your project type and roleIs it an infrastructure project, a stand-alone project or part of a common development? Are you the primary, secondary or tertiary permittee? Your answer decides which NOI you file.
  2. 2
Gather your project detailsCollect the project and ownership information EPD asks for on the NOI.
  3. 3
Submit the NOI onlineNOIs are submitted through EPD's online system, GEOS, which requires a GEOS login. EPD sends a confirmation email when the submittal is complete.
  4. 4
Start work once coverage is in placeRemember the 14-day rule: file at least 14 days before construction begins.
  5. 5
File a Notice of Termination when you finishWhen the project is complete and meets the stabilization and permit requirements, you file a Notice of Termination (NOT) to end coverage.
